Joyce Case Sues Legoland for Negligence in San Diego Court


On Monday, June 8th, Joyce Case, a Los Angeles County resident filed a negligence lawsuit against the Legoland California Resort in the San Diego Federal Court, California. The civil suit is a class action against the entertainment franchise for failure to return the monies paid for tickets to the theme park before it closed its doors in March because of COVID-19.

Documents filed by Case on behalf of herself and others affected by the park’s closure showed that she is suing for negligence, fraud, and conversion. Other complaints listed in the lawsuit are violation of California’s Consumers Legal Remedies Act, false advertising, unfair competition, and breach of contract.

Others are money had a received, and unjust enrichment. The document claimed that Case was unable to get a refund for the ticket she bought directly from Legoland during the park’s closure. She claimed that she should have gotten her money immediately, as should many others who needed it for other purposes.

The plaintiff wants a jury trial and wants the court to grant everyone in the class action ticket refunds, and the money paid for memberships and vacation packages that they were unable to attend. The other defendants listed in the lawsuit are Merlin Entertainment, Legoland’s parent company, Madame Russauds Hollywood and San Francisco, and San Francisco Dungeon.

People residing in the United States, who paid for tickets, membership, or vacation packages between March 13th, 2016, and the application opt-out date, can join the lawsuit if they desire.
