Rachael Dayton Injured in Auto-Pedestrian Accident on State Route 273

At about 1:15 a.m. on Saturday, September 12th, a vehicle struck a pedestrian on State Route 273 north of Canyon Road in the Redding City area of California. The Redding Police Department listed city resident, Rachael Dayton, 25, as the victim.

The RPD said in the accident report that the events leading to the crash began with 39-year-old Sarah Carpenter of Redding. The woman was behind the wheel of a Honda Civic heading north on SR-273 when she struck Dayton.

The investigators said that Carpenter did not see the victim and her male companion as they crossed the road outside a crosswalk. They added that the motorist stopped her vehicle after the collision, checked on the pedestrian, and waited for emergency services.

Dayton sustained severe injuries, and medics conveyed her to Mercy Medical Center using a road ambulance. Medical personnel at the hospital expects her to survive. The police said that the victim was at fault in the accident for crossing the road outside a designated crosswalk.

The RPD also determined that Carpenter was intoxicated when the incident happened and arrested her for felony DUI causing injury. They booked her into the Shasta County Jail. Anyone with relevant information should contact the police on the listed line.     

Under California law, when a victim plays a role in the occurrence of an accident, the defendant in a civil lawsuit can raise a defense of contributory negligence. The latter means that the plaintiff failed to exercise reasonable care for their safety and reduced compensation.
