An 18-year-old teenager, Andrea Higuera, from Delano, California, was involved in an accident on Wednesday, February 12th. The crash happened on Highway 99 near Turlock, resulting in severe injuries for the young woman.
Higuera suffered multiple lacerations and a compound fracture to her arm. She was traveling in the company of an adult male whose identity has not been revealed.
The unnamed male was driving the teenager in a Honda, and they were southbound. At about 11:15 p.m., close to Lander Avenue, the car hit the center dirt divider and lost control.
The car spun and hit a concrete barrier before overturning and becoming a wreck. The driver sustained some injuries, but not as severe as Higuera.
The California Highway Patrol is investigating what might have led to the car losing control. So far, it has ruled out intoxication as a contributing factor.
Under California law, the CHP must rule out carelessness or negligence on the part of the driver to determine the level of liability to a victim. It also helps determine if the person behind the wheel should get charged or not.
Other law enforcement agencies have the right to carry out investigations. Insurance companies also have inquiries to determine the liability or lack of it of the insured.
Where the driver is found guilty, the victim is entitled to sue for compensation in a court under the personal injury law of California. The settlement would cover medical bills, future medical care, emotional trauma, and the pain and suffering of the victim.
