A suspected DUI driver who crashed and totaled his car in a single-vehicle collision in Modesto, California, would need a drunk driving attorney’s advice. 30-year-old Andrew Melendez struck a tree with enough force to knock it down on Monday morning, July 13th.
According to Sharon Bear, the spokeswoman of the Modesto Police Department, they received a call about the incident at about 12:30 a.m. The initial report showed that Melendez was westbound on West Orangeburg Avenue in a 2005 Nissan when he went off the roadway and struck a tree.
The accident occurred precisely on the 1900-block of Orangeburg, east of Highway 99, where there’s a curve in the road. Paramedics took Melendez to a hospital for treatment on non-life-threatening injuries. Bear said he was alone in his car; he showed signs of impairment, and officers cited him for driving under the influence.
Under the California Vehicle Code, a person drives under the influence when he or she consumes drugs or alcohol and gets behind a vehicle in that state. Whether there’s an accident or not, a person cited for DUI would have to appear in court and, if found guilty, be liable to several punishments.
The latter depending on the circumstance of the case, and the number of convictions the person has would include time in jail and payment of a fine. The offender would also have his or her driver’s license revoked and attend a compulsory alcohol re-education program.
