On Sunday, February 16th, April Dawn Wigand, 39, lost her life in a fatal single-vehicle crash. The accident happened on Old Highway 395 in San Diego at about 2:08 p.m.
Wigand was a passenger in a sports car driven by an unidentified driver. The driver, along Reche Road, was trying to overtake other vehicles at high speed and crossed into the lanes heading north.
The driver met with oncoming traffic and swerved back into the south lane he was driving on. At this point, the unnamed person lost control of the car and drove off the roadway.
The car struck a tree and rested in a creek bed at the bottom of an embankment. Wigan and the driver died on impact, and first responders could do nothing to revive them.
The California Highway Patrol and the San Diego Police Department are investigating the crash. The authorities are also trying to identify the driver and will perform an autopsy into the primary cause of death.
Improper passing maneuvers is an offense under California law. Traffic laws state that drivers must use the utmost caution when attempting to overtake other vehicles on the roadway.
Passing other vehicles is illegal when there isn’t enough space or if other potential dangers exist. Under California Vehicle Code 21750-21759, a person who overtakes illegally is liable to pay a fine of $238.
The driver will also have it on his or her DMV record. If the person accumulates several points in 3 years, the DMV will list him or her as a negligent operator, and suspend or revoke the person’s driver’s license.
