The city of Antioch, California, lost a minor last week in a vehicle-versus-pedestrian accident. On Monday, March 2nd, the Antioch Police Department revealed his name as Elijah Holland, an 11-year-old boy.
The accident that claimed the life of the young child occurred on Thursday, February 27th, on the Lone Tree Way near Deer Valley Road. A preliminary investigation by the police uncovered that Holland attempted to cross the road outside a crosswalk.
While at it, an oncoming vehicle, whose driver could not avoid the boy in time, knocked him down. APD was called to the scene at about 6:45 p.m. and found Holland lying on the road.
Paramedics checked the young boy, found him unresponsive, and pronounced him dead. The driver of the vehicle went unscathed, but a passenger in the car sustained minor injuries and was taken to the hospital for treatment.
The driver stayed at the scene to speak with the police and gave an account of what happened. The police have ruled out driver’s impairment as a contributing factor, but they are still investigating.
When an accident occurs, and there’s a criminal or civil trial, the courts always look at the liability of the driver before passing sentence or awarding damages. When the victim is the one whom the responsibility lies with, the court will dismiss the case.
California traffic law makes it easy for the court to arrive at who has the liability in an accident. The law states that pedestrians should only cross the road at crosswalks to avoid accidents, and when a person fails to that, he or she becomes the negligent party unless the driver is impaired in any way.
