A medical emergency made a man crash his car on Tuesday morning, August 11th, in Pacheco, Contra Costa County, California. The California Highway Patrol named 67-year-old Joaquin Azevedo as the victim.

The agency’s accident report disclosed that the man suffered a heart attack while driving a white Dodge Durango on Santa Fe Avenue. The medical emergency happened at about 8:04 a.m. as Azevedo approached Rose Street. He veered off the road, and the car slowly rolled into a fence.

When it comes to motor vehicle accidents, several human-made and external factors contribute. The latter is usually beyond the motorist’s control, and an example is an underlying medical condition or medical emergency. It covers heart attacks, diabetics Miletus, or an epileptic attack.

An accident caused by an underlying medical condition poses the question of whether or not the driver involved was negligent. If there’s a victim other than the motorist, the court will look at liability from the angle of prior knowledge and the driver’s inaction in preventing the occurrence.

If the motorist was not aware of the medical condition, he or she could use it as a defense. The person would need to show that the loss of capacity of consciousness happened without any warning or ability to prevent the accident. That it was a completely unforeseeable medical condition, and it caused the driver to lose control.
