On Wednesday, February 26th, local authorities in San Jose, California, released the name of the woman who died in a vehicle-versus-pedestrian accident in the city. She is 55-year-old Maria De Jesus Lopez Curiel.
According to authorities, Curiel died while receiving treatment in the hospital for her injuries. The police have not stated if there will be an autopsy but believe the death to be an accident resulting from blunt force trauma.
The deceased was involved in an accident on the night of Saturday, February 22nd, at about 7:20 p.m. Curiel was in the company of a male pedestrian, and they were walking in the area of West San Carlos Street and Brooklyn Avenue, near Bascorn Avenue.
The two got hit by a car and sustained life-threatening injuries. They were transported to the local hospital, and unlike Curiel, the unidentified male passenger survived, and remained in the hospital over the weekend.
The driver whose name the authorities withheld, stayed at the scene of the accident to help police with their investigation. So far, the driver has not gotten cited, and the police have not stated if drugs or alcohol played a role in the accident.
When an accident happens, the driver should stay behind and cooperate with the authorities rather than flee the scene. The courts in California always take into account the driver’s actions when there is a lawsuit.
It helps the court to mitigate the verdict it would give if there’s a criminal charge, and the damages to award when there’s a civil suit.
