On Monday, April 6, one week after a 29-year-old Oakland man, Desmond King, was killed in a vehicle-pedestrian collision in Oakland, California, the Oakland Police Department has disclosed the charges leveled against the alleged culprit. Given the circumstances, the expertise of a drunk driving attorney may be required.
Witness accounts reveal that the alleged DUI motorist, Miguel Rodriguez, 29, was traveling westbound on Bancroft Avenue at a high speed. Just as the motorist approached the 5400 block, he suddenly veered left to bypass a vehicle in front of him and then overcorrected into the westbound lanes.
The sudden maneuver caused the 2013 Chevrolet Malibu to hit a parked car on the emergency lane before crashing into apartments on 5452 Bancroft Avenue. It then slammed into the cement staircase on 5450 Bancroft Avenue, knocking down four pedestrians on its path.
The out-of-control car finally came to rest in the middle of the street, after overturning onto the passenger side. The motorist abandoned the vehicle and fled the scene, but was apprehended soon after.
One of the victims died in the crash, while the other three escaped with non-life-threatening injuries. The injured pedestrians identified the suspect after his arrest.
Miguel Rodriguez was discovered to be under the influence at the time of his arrest. Substances suspected as cocaine powder and crystal methamphetamine were also found in his possession.
He was booked into the Santa Rita Jail, with a bail capped at $380,000. The suspect faces charges of vehicular manslaughter, three counts of DUI causing injury, five counts of fleeing an accident scene, and two misdemeanor counts of possession of a controlled substance.
A plea hearing was slated for Tuesday, April 7. The timely intervention of a drunk driving attorney is vital before the case proceeds further.
