On Monday, March 2nd, the authorities in Fullerton, California, detained Mustapha Baion, 34, in connection to a DUI vehicle-versus-pedestrian crash. The latter happened along Orangethorpe Avenue, late on Sunday, March 1st.
A police investigation uncovered that Baion was under the influence of drugs when the crash occurred. He was traveling in a silver Honda sedan when he knocked down a female pedestrian crossing the avenue.
When paramedics arrived at the scene, they found the unidentified woman lying on the roadway with severe traumatic injuries at her lower extremities and a result of the collision. An ambulance took the injured woman to the hospital, and she is still alive at the time of this report.
Baion stopped his car after the crash and tried to answer the questions of the police as lucidly as possible. He was arrested on suspicion of DUI and is in police custody.
A person gets a DUI charge in California when he or she goes behind the wheel under the influence of drugs and alcohol. The California Vehicle Code frowns against it and offers strict punishment when there’s an injury.
A first time DUI causing injury is considered a wobbler offense, meaning the prosecutor can charge it as a misdemeanor or felony. It depends on the circumstances of the case.
A misdemeanor DUI conviction gets a person up to a year in county jail, a $1000 fine, and suspension of driver’s license for a year. A felony means three years in county jail, a fine of $5000, and driving privileges suspended for three years.
