Pamela Guisti, 8 Others File Negligence Lawsuit Against Princess Cruise Lines For Coronavirus Exposure


Nine passengers onboard the Grand Princess cruise to Hawaii from San Francisco on February 21 have filed a negligence lawsuit against Princess Cruise Lines and the parent company, Carnival Corp. The lawsuit, which was brought before a San Francisco federal court on Wednesday, April 8, proposed an alleged negligence on the company’s part for exposing its passengers to the coronavirus.

The ship reportedly began its return to San Francisco, California, on February 29, after an eight-day trip off the coast, and then docked in Oakland on March 9. Prior to its Hawaii Voyage, the vessel made a trip to Mexico, with 62 passengers from the Mexico cruise continuing to Hawaii.

The court papers stipulated that on February 25, a previous passenger, who was with the Mexico cruise, died of COVID-19, which should have raised concerns about the safety of the remaining passengers.

On March 5, 19 of the 1000 crew members and two passengers tested positive for the virus. By March 26, the figures had increased to 103, with three deaths recorded.

Since the outbreak, several passengers have filed lawsuits against the company, including nine northern Californians. One of them, identified as Pamela Guisti, a San Mateo County resident, came down with the virus and was subjected to treatment in an ICU.

The others were quarantined aboard the vessel for days and later subjected to another isolation session at the Travis Air Force Base for extra measures. All the while, the eight victims nursed fears of testing positive, which left them traumatized even after being cleared.

The lawsuit accused the cruise companies of negligence, for failing to notify them of earlier passengers with COVID-19 symptoms.

It also stressed the companies’ negligence for not informing passengers of the previous traveler’s death, and not quarantining passengers until March 5.

The lawsuit demands compensation for damages which covers medical expenses, lost earnings and emotional distress, extended to all the passengers on the Hawaii cruise.
