Torres Lee Dawson Gets Charged with DUI Vehicular Manslaughter for Bakersfield Accident

The city of Bakersfield, California, on Monday, March 23rd, charged to court the man who caused an accident while under the influence. Torres Lee Dawson is facing a charge of DUI vehicular manslaughter without gross negligence.

The crash caused by Dawson occurred last month, on February 14th at about 6 p.m. at the intersection of Chester Avenue and 2nd Street. The Bakersfield Police Department said the driver made an unsafe turn while driving a pickup, and crashed into a motorcycle at the intersection.

The driver of the motorcycle identified as Deion Shaquille Nobles, 24, sustained severe injuries and died from his wounds. Dawson has not taken his plea, and he is set to appear in court on May 4th.

Drinking and driving is a severe traffic offense in California. The law of the state provides that drivers should not have more than .08 blood alcohol content while driving.

Having beyond that is a traffic offense, and when an accident occurs, it becomes a criminal offense that is charged either as a misdemeanor or felony. In trying the case, the court will consider that the offender drove a vehicle.

The court will consider that at the time the person was behind the wheel, he or she was under the influence of alcohol, drug, or a combination of both. That the person committed an illegal act or neglected to perform a legal duty.

That the failure to perform the duty led to bodily harm or the death of another. The possible punishment includes jail time, a fine, and suspension of driving privileges.
