Two-Vehicle 57 Freeway Crash Eric Phan, Injures Another; DUI Suspect Unhurt


In a tragic, suspected DUI accident death, Eric Phan, age 34, of Midway City, lost his life when the 2002 Jeep Liberty in which he was a passenger was rear-ended by a second vehicle and plunged over a cement barrier on the 57 Freeway near Orange at 2:15 a.m. on Saturday, March 14, 2005.

Death and Injury

According to the coroner’s office, Phan was pronounced dead on the accident scene. Another person, Neil Raboy, age 36, of Huntington Beach, who was driving Phan’s vehicle, was seriously injured in the rear end collision. Raboy was transported to UCI Medical Center for emergency treatment of what was described as major head trauma suffered in the auto accident. The driver of the second vehicle, Rebecca Munoz, age 22, of Santa Ana, was not injured in the dangerous highway accident.

Did DUI Driver Cause Fatal Accident?

According to police, the second vehicle, a 2014 BMW driven by Munoz, slammed into the rear end of the Jeep carrying Phan and Raboy, causing the Jeep to flip over a barrier, landing on its roof in a freeway on-ramp. Munoz was believed to have been intoxicated when she rear-ended the Jeep at a high rate of speed. Munoz was arrested and charged with suspicion of gross vehicular manslaughter.

This combination of facts – a rear-end collision, speeding, and drunk driving – makes it highly likely that Munoz will be held legally responsible for causing the deadly motor vehicle collision. In addition to being convicted of manslaughter committed with an automobile, Munoz (and various insurance policies) may be liable for civil legal damages for Phan’s wrongful death and for Raboy’s personal injury resulting from the car crash.
