Toddler Killed, Mother Injured in Pedestrian Accident

LOS ANGELES – A 10-month-old toddler was killed Thursday morning, when the child and mother were hit by a pickup truck at the intersection of Broadway and 59th Place in South Los Angeles.

According to local police, 36-year-old Juana Oxlaj was crossing Broadway westbound at the north crosswalk of the intersection at 59th Place around 7:10 a.m. with her child. The driver, 38-year-old Esteban Carbajal of Los Angeles, hit the mother and child in the crosswalk as he turned left onto Broadway.

Carbajal stopped at the scene following the accident – neither drugs nor alcohol are suspected as factors.

The victims were taken to California Hospital Medical Center. The mother suffered head trauma, but is now listed as being in stable condition. The infant was pronounced dead at the hospital.

The crash is now under investigation by the LAPD’s Central Traffic Division.

Pedestrian Accidents

In California, pedestrians have the right-of-way. It is the responsibility of motorists to steer clear of any person on foot in our roadways. When a pedestrian is struck and injured or killed by an automobile there is the potential of both a criminal case and a civil case against the driver of the offending vehicle. Civil action seeks to hold the driver financially liable for injuries and damages.
