An accident on Sunday, February 16th, left three people injured with two severe trauma. The driver of the vehicle later got identified as 42-year-old Zachary Boswell of Cambria.
An investigation by the California Highway Patrol uncovered that Boswell was driving a Polaris Ranger at around 9:30 p.m. with five people inside, including himself. When he got to State Route 1, South of Ragged Point, California, the car went off the road.
It went down a 30-feet embankment, ejected all five occupants out of the car, and landed in the State Route 1 lanes heading north. Boswell and his passengers were not wearing their seat belts.
He and an unnamed 33-year-old male passenger suffered significant injuries, and an unnamed 36-year-old woman had minor injuries. The trio got taken to the Sierra Vista Regional Medical Center.
A preliminary investigation by the local police found that Boswell was driving under the influence. He got arrested while receiving treatment at the hospital, and he is facing DUI charges.
Driving under the influence of any intoxicating substance is an offense in California. Boswell’s liability to his passengers is clear, and he also faces personal injury claims if they decide to sue.
Under California law, the driver’s blood alcohol content will get tested. It would be used by the court to determine his liability, and suspension of his driver’s license for three years is also a possibility.
In the civil suit, the court will also use the BAC to determine the duty of care Boswell owed his passengers. Then, it would award damages based on the degree of negligence exhibited.
