On Wednesday, February 26th, the Tulare County Superior Court, Tulare County, Fresno, California, received a lawsuit against the retailer brand, Walmart. The suit was filed by the brothers of Rocky Jones, the victim of a shooting accident.
The lawsuit is coming a little over a year after a shooter, identified as Gustavo Garcia, shot Rocky dead in December 2018. The deceased was shopping at a Walmart store in Visalia when the shooter opened fire.
Judy Jones, the brother of the deceased, said the store is liable for Rocky’s death for failing to secure its ammunition cabinet properly. Garcia, according to the witness report, kept reloading his gun with the ammunition obtained from the case.
Judy believes that the ammunition should have been appropriately secured, and wants Walmart to be held accountable for their negligent action. They want the court to grant damages to the tune of the loss they suffered.
Rocky was not the only person to die that day from Gustavo’s gun. A police report showed that there was another death that day, but the name of the victim was not released.
At the time of this report, there is no indication that the unnamed victim’s family would join in the Jones brothers’ lawsuit. Walmart has not been served, and Judy expects them to receive the notification in the coming weeks.
Lawsuits of this nature are not uncommon when a person suffers an injury while on business premises. There is a presumption that business entities owe their staff and customers a duty of care, and when that duty is breached, the court will hold them liable by making them compensate the victim(s).
