The woman who passed away in a fatal pedestrian crash in Riverside, California, has been identified. On Wednesday, March 11th, the authorities released her name as Manila Thavixay, 32.
The Riverside resident was killed on the night of Tuesday, March 10th, on Van Buren Boulevard. The woman was hit by a driver in a 2018 Kia Forte heading north as she crossed the road near Victoria Avenue.
The vehicle-versus-pedestrian collision took place at about 10:15 p.m., and the preliminary investigation uncovered that Thavixay crossed the road outside the marked crosswalk. Paramedics transported the woman with a land ambulance to the Riverside Community Hospital.
The doctors did all they could to keep Thavixay alive, but she succumbed to her wounds at about 10:49 p.m. The driver of the Kia, who was identified as a 23-year-old Riverside man, was unscathed from the injury and stayed behind to speak with the authorities.
The California Highway Patrol is heading the investigation to determine who the negligent party is, between the driver and the victim. They have asked anyone with helpful information to contact their Riverside office.
When an accident happens, different lawsuits arise depending on the surrounding circumstances. Often, the victim, or his or her representative, can bring a civil suit for wrongful death or personal injury.
However, the court in reaching a verdict will ensure that the fault lies solely on the driver and not the victim. If the court finds higher negligence on the part of the victim, then the case will get dismissed, and the person won’t get any compensation.
