Izeah Almaguer Charged with Second-Degree Murder for Tulare DUI Crash


As the city of Tulare, California, mourn the loss of Rudy Carrasco, 49, the man killed in a DUI accident, his killer has been officially charged. Izeah Almaguer, 23, on Wednesday, March 11th, was charged with second-degree murder.

Almaguer was driving while impaired on Wednesday, February 26th, when he crashed into Carrasco at the intersection between H Street and San Joaquin Avenue. The police report showed that the young man ran through a stop sign when the accident happened.

Almaguer refused to let the police carry out a breathalyzer test at the scene of the accident, and they took a blood sample, which they tested in the lab of a hospital. The test result showed that the young man had .13% blood alcohol content (BAC).

The legal limit under California law below is .08%, and further investigation showed that the Tulare resident was cited for driving under the influence in 2018. In addition, to the second-degree murder charge, Almaguer was charged with vehicular manslaughter while intoxicated.

He is also charged with driving under the influence of alcohol causing injury, and driving with at least .08 percent BAC causing injury. If found guilty on all counts and convicted, Almaguer faces life in prison.

Carrasco was the Dean of Students at Tulare Western High School until the time of his death. He was honored by the Fresno State’s Softball team by having his family throw the first pitch to his daughter, Kelcey, at a recent game.

Aside from the criminal charges, Almaguer might face a civil lawsuit if Carrasco’s family chose to sue. They can bring a wrongful death suit and ask the court for damages for the loss suffered.
