DUI Driver, Jose Toro, Arrested for Head-On Collision Near Bakersfield


A male driver who caused a head-on collision near Bakersfield, California, while driving under the influence would need the expertise of a drunk driving attorney. The California Highway Patrol arrested Jose Toro, 26, of McFarland on Sunday, June 14th, for the accident that claimed one life.

The accident report revealed that the CHP around 2:20 a.m. received a call about a crash involving two vehicles on Bena Road and Neumarkel Road. When officers arrived at the scene, they found that the collision involved a 2016 BMW and a 2003 Subaru WRX.

The preliminary investigation uncovered that Toro drove the BMW westbound on Bena, while an unidentified 21-year-old was heading east in the Subaru on the same roadway.   For reasons that remain unknown, the suspect left his lane and crossed over into the east road, directly into the other car’s path.

The two collided head-on, and the impact left the driver of the Subaru fatally injured. A 19-year-old passenger sustained minor injuries and received treatment at the Kern Medical Center. Toro also sustained non-fatal wounds, and the medics took him to the same hospital.

The CHP determined that the suspect was under the influence of alcohol and arrested him on suspicion of DUI after receiving treatment. There is no additional information, and the investigation is active.

Under California law, a driver must have below .08 blood alcohol concentration when driving. Failure to do so is a traffic offense that turns criminal when a person dies, and the offender faces time in jail, fines, and suspension of driving privileges.
