A young man tragically lost his life on Highway 101 in San Jose, California. Olman Aparicio Ayala, 23, passed away on Saturday, March 7th, after getting hit severally, by different vehicles.
Ayala met his death in the morning at about 5:40 a.m. on Highway 101 near Interstate 880. A report by the California Highway Patrol showed that the deceased was driving a ’97 Acura which he crashed in a single-vehicle accident.
Unscathed, Ayala alighted from his damaged car and had barely gotten his bearing when a 2014 Dodge, driven by an unidentified driver struck him. The hit was immediately followed by a second from a 2019 Chevy, driven by another unknown driver.
The Chevy went on to hit a ’99 Lexus, putting an end to the multiple strikes. Ayala was unresponsive and already dead by the time first responders got to the scene, and they pronounced him.
The unidentified drivers sustained minor cuts and were taken to the hospital for treatment. The CHP did not release any information about the driver of the Lexus, or if he or she sustained any injury.
The CHP has not provided any additional information at this time, and the investigation is ongoing. Accidents often occur due to the negligence of drivers, brought on by distractions or impaired driving, or that of the victim.
When an accident happens and a lawsuit arises from it, the courts will always consider who has the highest degree of negligence in reaching a verdict. When the liability rests on the part of the victim, the court will, in a criminal trial, acquit the driver, and in a civil lawsuit, dismiss the case against the motorist.
