On Sunday, February 9th, a man got killed after the vehicle he was driving in had a head-on collision with another in the Monterey Park area of Los Angeles. He has now been named as 35-year-old male, Jaime Tellez Solis.

Based on a report by the West California Highway Patrol, the wreck occurred about 4 p.m. It happened near Valley Vista Drive, precisely on West Valley Drive.

The two vehicles involved in the accident collided on the roadway. Investigations by the Highway Patrol have not revealed what caused the cars to crash.

Solis died on the scene, but an unidentified woman traveling in the other vehicle lived. It took a while to extricate her from her car; immediately after, she got transported to the hospital, where she is still undergoing treatment.

Accidents like this one, which claimed the life of Solis, often lead to lawsuits. The State of California allows surviving family members to recover from financial losses caused by a wrongful death.

To prove that a death was wrongful, certain legal elements are required under the California Code, Code of Civil Procedure, to rule out a counter negligence lawsuit against the victim.

The burden of proof would be on the person who asserts. Unlike in criminal cases, the evidence is not beyond a reasonable doubt but must have a  51% chance of convincing the court.

The court will take into account the role the victim played in the accident. Every driver is expected to drive safely based on the manner and condition of the road he or she is traveling on.

At the time of this report, there is no additional information on Solis’ accident, and the investigation is still ongoing.
