The Santa Clara Police Department has identified the young man who lost his life in the vehicle-versus-pedestrian crash in Santa Clara. They released his name on Tuesday, February 18th, as a teenager, Juan Pacheco.
The accident happened on Sunday, February 16th, in Santa Clara, California, at about 9:20 p.m. It happened precisely at Lafayette Street and Agnew Road.
The deceased was trying to cross the street when a black Honda Accord that was traveling south on Lafayette Street hit him. Pacheco never made it to the hospital as he died on the scene.
The driver of the Honda, whose identity the police did not release, stayed back to talk to the authorities. The SCPD believe he was not driving under the influence of drugs or alcohol.
The SCPD is still investigating the cause of the accident and hopes to uncover the reason soon. Under California law, Pacheco’s family can sue the driver for personal injury claims and bring a suit for wrongful death.
The court would award damages as it deems fit for loss suffered by the deceased’s family. Under the California wrongful death law, the court can grant much more than compensation.
The compensation would cover the funeral and burial expenses of the deceased, as well as the projected amount the deceased would have earned, had he or she lived. The court would also award damages for loss of companionship.
A wrongful act includes two-vehicle collision when one person is a DUI driver, pedestrian knockdowns, and slip and fall accidents. When any of these happens, the person injured or a parent, guardian, or family representative can sue.
