A man who sustained injuries in an auto-pedestrian crash in the Westwood area of Los Angeles, California, filed a negligence lawsuit against the driver that struck him and three others. The civil action was filed on Tuesday, June 9th, by Matthew Ryan at the Los Angeles Superior Court.
The court documents list a restaurant in Westwood, Pinches Tacos, the driver of the vehicle, Elizabeth Pasternak, the city of Los Angeles, and UC Regents as the defendants. The accident that injured Ryan occurred on June 4th, 2019, in Glendon Avenue, about noon.
At the time, the crash report revealed that Pasternak, a UC Regents rep, struck Ryan, who was walking on the sidewalk in front of the restaurant. The collision left Ryan injured on his left knee and lower body. The female driver told the LAPD at the time that she was driving at 15 miles per hour, and was turning right to park in an angled space on the street in front of the restaurant.
The woman was unable to apply the brake and drove through the front door of Pinches striking a pillar. The lawsuit alleges that UC Regents, the city, and the restaurant owed pedestrians a duty to put barriers and signs on the property to make it safe.
Ryan claims that the defendants were negligent, and alleges premises liability and dangerous condition of public property. The victim did not indicate the damages he wants, and none of the defendants have responded to the lawsuit.
