Pedestrian, Francisco Torivio, Dies in Santa Ana Fatal Accident

41-year-old Francisco Torivio lost his life in an auto-pedestrian accident in Santa Ana, California, on Tuesday, June 23rd. The accident report disclosed that a suspected DUI driver struck the man at Bristol Street and McFadden Avenue.     

The crash happened around 1:40 p.m. as Torivio walked through a crosswalk on the roadway. The vehicle involved, a white BMW, was driven by 26-year-old Kevin Guardado, and the man reportedly had a green light when he drove through the intersection.

The Santa Ana Police took Guardado into custody on suspicion of DUI after failing a field sobriety test. The investigation is still ongoing to determine fault, and the investigators will release an update at a later time.

Fault or liability is one of the critical determinants in proving who acted negligently in an accident. Depending on the facts and circumstances of the case, the possible charges that arise from a collision include a hit-and-run, suspicion of driving under the influence of drugs or alcohol and vehicular manslaughter.
