A 30-year-old, who authorities have identified as Joshua Muller, of Arbuckle, killed his wife, Sarah Muller, 39, in a single-vehicle accident. The crash occurred at about 9:30 p.m. on the night of Saturday, February 22nd.
The young man was driving a special utility vehicle, which he crashed into a tree on Railroad Avenue, north of Niemann Street. Sarah was seated in the passenger’s seat when the accident happened.
The first responders found the deceased unresponsive when they arrived at the scene and pronounced her dead from the injuries sustained from the crash. Her husband, on the other hand, did not sustain any life-threatening wounds.
Police ran a breathalyzer test on Joshua and found that he had a blood-alcohol level of .14%. The limit for the blood alcohol level for drivers in California is .08 percent, meaning that the driver’s BAC was quite high.
The police took Joshua to the hospital, where they arrested him after he got treated. The widower is currently in custody at the Yolo County Jail, and he is facing multiple felony charges.
Under California law, a DUI accident can either be a misdemeanor or a felony, depending on the circumstances of the case. When there is a death, it becomes a felony, and the offender faces a gross vehicular manslaughter charge.
The court will look at the facts of the case in arriving at a verdict, and a guilty person faces between four to ten years in state prison. Additionally, the person would have his driver’s license suspended for a couple of years until the court deems it fit to lift it.
