On Saturday, February 8, an accident occurred on Oceanside Boulevard between a motorcycle and a sanitation truck. According to the California Highway Patrol, the accident occurred at about 1:34 p.m.
The identity of the man on the motorcycle was finally released following the accident. The motorcyclist was identified as 59-year-old Timothy James Bauer of Oceanside. Bauer was heading westbound on Oceanside Boulevard.
As he was getting ready to pass the El Corazon Compost facility, a truck pulled out in front of him, causing him to collide with the truck.
The driver of the sanitation truck, 64-year-old Ronald Estes, was making a left-hand turn out of the facility which was directly in the path of the oncoming motorcycle. There has been no indication that Estes looked prior to pulling out of the compost facility.
Estes has been arrested based on a suspicion of gross vehicular manslaughter due to his gross negligence that caused the accident.
In the state of California, gross vehicular manslaughter can either be a misdemeanor or a felony charge, depending on the circumstances that lead up to the accident.
When negligent behavior is what caused the accident and subsequent death of the individual the minimum, misdemeanor sentence, could be up to a year incarcerated. If it falls into the felonious category, up to six years of incarceration.
No charges have been formally made against Estes at this time. The Oceanside Police are still investigating the accident for any additional details.
