Caleb Marsh Arrested More Than 1 Year After Smith County Wreck That Killed David Nelson

A Texas man has been arrested on a charge of intoxication manslaughter more than one year after a two-vehicle crash in Smith County that claimed the life of a Tyler man.

Caleb M. Marsh, 22, of Rusk, was arrested this week in connection to the December 2018 crash, according to authorities. The Texas Department of Public Safety said Marsh was under the influence of alcohol when he crashed into vehicle on a state highway, killing the other driver.

Marsh is being held in the Smith County Jail. A drunk driving attorney will represent him during upcoming court appearances.

Authorities said Marsh was driving westbound in the eastbound lane of Texas 64 about seven miles outside Tyler at about 11 p.m. Dec. 28, 2018. He eventually crashed head-on with an eastbound vehicle operated by David D. Nelson, 43, of Tyler.

Nelson suffered major traumatic injuries and was pronounced dead at the scene of the wreck, according to investigators. Marsh also was seriously wounded and was taken to a hospital.

Investigators said Marsh’s blood-alcohol concentration was 0.129%, which is higher than the 0.08% legal driving limit in Texas.

According to court records, a grand jury indicted Marsh in April. He was arrested Monday and was ordered held on a $150,000 bond.

If convicted of intoxication manslaughter, Marsh faces up to 20 years in prison. Court records do not show whether he has yet obtained the services of a drunk driving attorney.
