The court in California frowns at drivers who go behind the wheel when intoxicated with drugs or alcohol. In convicting someone for a DUI offense, the court under California Vehicle Code 23153(a) or (b) will take into account that first, the person drove a vehicle.
That the person was under the influence of alcohol, drugs, or both at the time the accident happened. The person performed an illegal act or failure to perform a legal act, and the inability to do the latter led to the death or injury of another.
When a death occurs, prosecutors in addition to the DUI charge will try the person for vehicular manslaughter. The latter comes with a 4, 6, or 10 years jail sentence.
