A grisly scene developed Friday morning in San Diego when a motorcyclist, heading south on Texas Street, onto the I-8 freeway, was nearly struck by a motorist who did not see them moving eastbound.
The motorcyclist was forced to accelerate in order to avoid being struck, causing him to hit a curb, losing control of their motorcycle. The motorcyclist was thrown over the on-ramp, landing in the brush beside the road. The motorcyclist sustained serious injuries, losing a leg, according to a report on Fox 5, and he remains in critical condition at last report.
The incident begs the question of responsibility when two vehicle operators are involved in an accident that does not involve one auto striking another. Had the driver struck the motorcyclist, the case might be a little more cut and dry, but the lack of physical contact complicates the story. This is where expert legal counsel comes in.
