A 13-year-old boy was killed Monday night, October 8 in a two-vehicle collision just before 11:00 p.m. in Upland at the intersection of Campus Avenue and Arrow Highway. When police officers arrived at the scene, they found a white pickup truck that collided with the red compact car the boy was riding in. The force of the collision caused the sedan to collide with the carport of a vacant house, causing a partial collapse of the carport roof. The car the youth was riding in caught fire, but police officers were able to extinguish it before the Upland Fire Department arrived.
IMPACT & POLICE INVESTIGATION
Police investigating the crash stated that the boy had died on impact, while his mother, who was driving, was transported to the hospital with non-life threatening injuries. The driver of the white pickup truck, 21-year old Kyle Bahensky, fled the scene on foot but was later arrested at his home in Upland.
Bahensky was arrested and booked at the West Valley Detention Center on charges of hit-and-run at his home in Ontario. Further charges may be brought pending an investigation. It is unknown at this time whether alcohol or drugs played any role in the accident.
HIT AND RUN CHARGES / FELONY HIT & RUN / DUI
As for hit-and-run accidents, there is a presumption in law that a person who flees the scene of an accident was responsible for the accident, was under the influence of alcohol or drugs, or otherwise was at fault or impaired at the time of the accident. The law states that innocent people do not flee the scene of an accident. At this time, the exact cause of the accident is not known and an investigation, but Bahensky’s action in fleeing the scene points a finger at him for causing the accident.
