Bria Health Services is facing two more wrongful death lawsuits in connection with the COVID-19 related deaths of two patients.
Based on Kane County court records, this brings the number of claims against the long-term care facility in Geneva to six.
The two latest lawsuits were filed on behalf of the families of Marion May Heotis and Carol Orlando.
Heotis died on April 29 and her family sued the company on June 1.
Orlando passed away on April 25 and her family filed legal documents on June 5.
The other residents of the nursing home who died were Helen A. Osuchas, Lucille Helen James, Rose H. Doneske, and Jack DeFrancesco.
The lawsuits contend that the owners of Bria opted to ignore the necessary safety measures that would protect residents and staff.
The attorney representing five of the families said the claims are aimed at holding management accountable and ensuring that other people don’t suffer the same fate.
Each suit is seeking more than $50,000 in damages. They allege that the Bria facility ignored mandates from Governor J.B. Pritzker and directives from state and federal agencies.
However, in mid-May, Bria said it had been adhering to public health guidelines that evolved as new information became available.
The company’s statement said testing was not immediately available and several residents and workers were asymptomatic carriers. Bria said this created a “silent enemy impossible to detect and difficult to defeat”.
The company said this was why Illinois granted immunity to health care providers for COVID-19-related injuries.
Osuchas’ case is down to be heard on August 3 while the other suits are down for late August.
