Authorities: Waldemar Montalvo Jr. Was Intoxicated At Time Of North Aurora Crash


Authorities said an Aurora man was intoxicated and transporting children when he crashed his vehicle in Kane County.

Waldemar Montalvo Jr., 40, was arrested on two counts of aggravated driving under the influence and a felony charge of aggravated assault of a police officer, according to a release from the Kane County State’s Attorney’s Office. No injuries were reported as a result of the wreck.

Investigators said the man was driving on Miller Drive in North Aurora just before midnight March 28 when he crashed his vehicle. Three young children were in the vehicle at the time of the wreck.

Police arrived on scene and spoke with Montalvo.

“Montalvo allegedly displayed signs of alcohol impairment, became combative and intentionally spat at officers several times after claiming to possibly be infected with the coronavirus COVID-19,” officials from the state’s attorney’s office wrote in the press release.

Police said Montalvo also was driving even though his license had been suspended due to a prior DUI conviction.

He made an initial appearance March 28 in Kane County Bond Court. He was released on bail and was ordered to appear in court May 7, according to the press release.

Montalvo likely will want to consider securing the services of a drunk driving attorney.
