Family of Pwar Gay Files Wrongful Death Lawsuit Against Tyson Foods


Tyson Foods is now facing a wrongful death lawsuit in Texas.

It comes after meat-cutter Pwar Gay died from COVID-19 on May 8 following an outbreak at an Amarillo plant.

The lawsuit was filed by Gay’s family. She worked at the meatpacking facility for eight years.

Gay continued to work even after the city imposed a stay-at-home order on April 1 to help slow the spread of COVID-19.

According to the lawsuit, she slipped and fell and injured her knees on the job during the pandemic. The company sent her to its clinic for first aid and then reportedly sent her back to work.

It is alleged that although Gay was suffering from pain and swelling, she was not permitted to seek medical attention or go home since the plant was short-staffed.

She reportedly continued working with a swollen and painful knee then started experiencing difficulty breathing because of a COVID-19 infection.

Gay spent several weeks in hospital because of both the knee injury and the coronavirus before she died.

According to the lawsuit, at least 4,500 employees of Tyson have been infected with COVID-19 and at least 18 of them succumbed to the infection.

The company is accused of failing to provide staff with adequate personal protective equipment and not facilitating social distancing.

The lawsuit also claims the company displayed malicious and grossly negligent conduct and callous disregard for the safety of its employees.

The suit was filed on May 15, 2020  by Gay’s husband, her four children, and a representative for her estate in the U.S. District Court for the Northern District of Texas (Amarillo Division).

The number of COVID-19 wrongful death lawsuits in the country is expected to grow.
