Failing to yield the right-of-way in Texas is considered negligence in the eyes of the law. There are basic elements that are considered to define negligence.

All drivers on the road are supposed to drive their vehicles with the proper care and skill as any ordinary person would do. The driver is negligent if they fail to do this by disregarding the basic traffic laws.

In the case of the semi-truck and the Taurus, the semi-truck failed to yield the right-of-way.

As a result of their disregard for the standard care, while driving, they cause injury or even death. This is considered a negligent act. The driver responsible did not care enough to follow the correct conduct on the road.

At this time there have not been any indications that the police are charging the driver of the semi-truck with negligence, the investigation is still ongoing.
