The parents of 18-year-old Jonathan Weaver have officially filed an injury lawsuit against Energy Transfer Partners for the death of their son.
The parents are claiming that James Darling, the man who caused the accident with Weaver was distracted while he was driving a company truck leased to Energy Transfer Partners in Big Spring.
The reports that were made at the time of the accident in April of 2019 by the Texas Department of Public Safety indicate that at the time of the accident, Darling may have been distracted. Darling was found at the scene of the accident with his phone still in his hand playing a pornographic movie.
Weaver’s truck is reported to have been compressed by almost 6 feet due to the collision.
Delena Weaver, the victim’s mother, has stated that she finds the entire accident senseless. There was no reason that the man should have had his phone out while he was driving, let alone watching pornography.
The lawyer who is representing the Weaver family in their lawsuit, Chip Brooker, has expressed that this is an extreme case regarding distracted driving.
Energy Transfer Partners estimated to be worth at least a billion dollars and the family believes that they should have had a way to monitor the employees driving their trucks to discourage cell phone usage while driving.
The family is simply hoping to make an impact and bring more awareness that distracted driving is a growing issue and they hope that it will serve as a wakeup call.
Energy Transfer Partners said that their hearts go out to the people who have been impacted by the tragic incident. They believe that the accident reconstruction tells a different story and will allow for it to be settled within the legal system.
