A fatal auto-pedestrian accident on Interstate 80 in Bureau County, Illinois, on Wednesday, September 9th, left a man dead. According to the Illinois State Police District 17 LaSalle’s office, Robert Bowen, 84, of Macomb, struck the victim a little after 10 a.m.

The accident report showed that the suspect was in the interstate’s left westbound lane when he struck the 47-year-old male pedestrian from Chicago. The investigators said that the victim, a highway maintenance worker, was standing outside his maintenance truck.

The vehicle, with its arrow board and a crash attenuator, was parked near milepost 44 while the victim assisted with traffic control in the maintenance zone. The ISP cited Bowen for failure to yield the right of way to any authorized vehicle or pedestrian working within a highway construction or maintenance zone. He would need a top accident lawyer.

The accident remains under investigation. Failure to yield is a traffic offense under the Illinois Vehicle Code. The law states that when two cars enter an intersection from different roadways at approximately the same time, the driver on the left must yield the right of way to the car on the right.

There are several types of failure to yield laws like failure to yield to emergency police, fire, or ambulance vehicles. Others are failure to yield to a flashing red or yellow light, failure to yield to a pedestrian walking in a crosswalk or approaching a crossing area, and failure to yield to children in a school zone.
