Ricardo Saldana’s Family Sues Nursing Home for Negligence After His COVID-19 Death


The family of an elderly man who died last month from the new coronavirus infection is suing a nursing home for orchestrating his death in Los Angeles, California. Relatives filed a negligence lawsuit against the facility on Thursday, May 21, alleging failure to provide adequate safety conditions at the home during the coronavirus pandemic.

The lawsuit, filed in Los Angeles Superior Court, accuses Glenhaven Healthcare of negligence, elder abuse, willful misconduct and wrongful death.

Ricardo Saldana, 77, first became affiliated with the nursing home in 2014. Court papers show that after suffering a stroke in May 2014, the victim got admitted to Elms Convalescent Hospital. The man remained at the facility undergoing treatment even after Glenhaven acquired it at a later time. Saldana’s family believed he was actively convalescing until he came down with the virus.

The suit alleges that the facility failed to put appropriate safety measures in place to curb the spread of the virus within the facility. Despite the then active state of emergency imposed in Los Angeles County, Glenhaven neglected the safety of its occupants, forbidding staff from wearing protective coverings, the lawsuit alleges.

After a nursing staff notified Jakie Saldana, a relative, of the policy, they informed health officials, forcing the facility to lift the ban on wearing masks in early April. The lawsuit states that despite the implementation of protective coverings, Glenhaven failed to introduce a policy for isolating proven or suspected cases of COVID-19.

According to the court papers, the facility made Saldana share a room with a resident who formerly bunked with another resident that tested positive. Shortly after the arrangement, Ricardo Saldana began showing symptoms of the virus and eventually died from it on April 13.

The negligence lawsuit seeks unspecified damages.
