A year after Sidney J. Flinn ran down his girlfriend, Brittany M. Shelton, while driving under the influence, he bags a five-year prison sentence. The Macon County District Circuit Court Judge, Thomas Griffith, pronounced the verdict on Wednesday, February 19th.
Flinn, 28, had stood trial for aggravated driving under the influence of alcohol. He pleaded guilty after his arraignment and took a plea deal that made the District Attorney drop the charges of reckless homicide, and aggravated DUI.
The young man who has a DUI conviction from 2011 faced a maximum sentence of 12 years under the latter charge. He is expected to serve 85% of his five years, along with custodial probation.
The accident that killed Shelton occurred on February 16, 2019, at about 2:30 a.m. The deceased and Flinn had been drinking and partying with friends for an extended time in Decatur, Illinois.
The two had an argument that ended with the convict driving off in his white pickup truck, and leaving the deceased to fend for herself. Shelton decided to walk home and was in the middle of the 3500-block of Greenhill road when Flinn’s truck hit her from behind.
The truck was travelling at 55 to 60 mph in a 30-mph zone, and the impact sent the deceased flying down the road. Shelton’s spine got broken, and an autopsy at the time showed that she died as soon as she hit the ground.
Flinn left the body on the road, and only put a call across to his father and a friend who called 911. After his arrest by the Decatur Police, a toxicology test showed his alcohol level at .091, and he also had traces of cannabis.
