Gregory Ivan Jackson II Killed on Unlit San Antonio Street

There has been yet another serious accident in a Texas city. A pedestrian was struck by a car on Thursday night as he walked along a dark, unlit south side street.

According to accident reports, the victim is 40-year-old Gregory Ivan Jackson II.

Police said the accident occurred after 10 p.m. on Highway 181 South, to the east of Old Corpus Christi Highway.

The authorities said a Ford Mustang was going east and because of the poor lighting, the driver couldn’t see Jackson who was wearing dark clothes.

The car struck him, and he died at the scene.

Police reported that the victim was walking in an area where pedestrians are not allowed to traverse.

They added that the unnamed driver was not intoxicated, and the person fully cooperated with the investigation.  According to police reports, the driver also called for help after striking Jackson.

As a result, no criminal charges will be filed, accident reports indicate.

This doesn’t automatically bar Jackson’s family from bringing a wrongful death claim against the driver.

Only spouses, children, and parents in Texas can file a civil lawsuit to recover damages, in some circumstances. Siblings, sisters, grandparents and cousins can’t claim damages as they would in some other states.

However, the deceased person’s estate can also recover medical expenses, pain and suffering, and other non-economic damages suffered by the victim before they died.

This is done by filing a survival action with help from an attorney.
