An Olympic high jumper, David Smith, of Atlanta, Georgia, is in a legal battle against Donggue Lee for an injury sustained in a car crash. The former on Thursday, March 5th, asked an Atlanta court to uphold its earlier judgment that granted him $2 million in damages.

The accident Smith sued for occurred in 2012 with Lee as the driver of the vehicle that crashed. The accident left Smith with a broken hip, which he had to undergo surgery to fix.

The high jumper was able to return to his sport and competed in the 2016 Rio Olympic games. Afterward, the young man had to go back under the knife to remove a bone chip, and claims in a court document that it is a resultant effect of his injury from the accident.

Smith’s lawyers claim that medical bills are still coming in, and the accident affected the future earnings of the young man. He wants compensation for the pain and suffering he went through, payment of medical bills, and further relieves the court deem “Just and proper.”

Lee, according to a February 10th Georgia Supreme Court ruling, acknowledged that he caused the accident. The case went to the superior court after the trial judge awarded Smith the $2 million in compensation.

Lee’s lawyers believe that the amount awarded would be less if the court had let them call an expert witness during the trial. The supreme court ordered that the lower court reconsider the damages awarded, and if possible, the case should get retried.

Smith’s lawyers are confident that their client will succeed a second time, and have prayed the court to uphold its earlier judgment and make Lee pay the money awarded.
