Judge Intervenes To Stop Deportation Of Driver In Plainfield Wreck That Killed Charles Schauer


A judge this week granted an emergency request to prevent the deportation of one of two drivers suspected of driving drunk in a January crash that killed an off-duty police officer near Plainfield.

Rodrigo Marin, 42, of Plainfield, must return to Will County to face drunk driving charges, a judge ruled Wednesday. Marin currently is in the custody of U.S. Immigration and Customs Enforcement due to the agency’s believe that he is in the United States illegally.

Marin is one of two drivers who authorities said crashed into a truck on U.S. 55 near Illinois 30 at about 6 a.m. Jan. 19. Investigators said Marin first crashed into the truck, which then was struck again by Erin Zilka, 36, an off-duty Joliet police officer.

Marin reportedly fled the scene. Zilka’s passenger, 33-year-old Charles Schauer, was pronounced dead at the scene as a result of injuries sustained in the wreck.

Investigators determined both Zilka and Marin were intoxicated at the time of the collision.

Marin was arrested on charges of aggravated driving under the influence, driving on a revoked or suspended license and leaving the scene of a crash. Zilka, meanwhile, faces a misdemeanor charge of driving under the influence.

Marin was incarcerated for about a month before he was able to post bond. However, ICE agents arrested him shortly after his release.

Marin allegedly asked for voluntary removal, which means ICE agents would deport him within 14 days of the request without intervention.
