Five Families File Lawsuit Against Arbor Terrace in Connection With COVID-19 Deaths in Cascade


The families of five elderly citizens who died after contracting the coronavirus in a senior care home,  Arbor Terrace, in Cascade, Georgia, have sued the assisted living facility. The lawsuits, which were brought forth on Thursday, April 23, accused the facility of negligently failing to protect its residents from the virus outbreak.

The facility, which is one of the hardest-hit homes in the State of Georgia, has recorded at least 52 cases of COVID-19 since the pandemic, with 15 deaths.

State records also show that no fewer than 34 members of staff in the facility have also come down with the virus, according to the Department of Community Health.

The records reveal Arbor Terrace to be the caregiving facility with the second most viable cases of COVID-19 deaths, second to a nursing home in Albany, which has a record number of 17 deaths.

A legal representative of the family, identified only as Rod Edmond, claims the families have a legal basis for their lawsuits as they offered payment to the senior care home to provide security and protection to the victims.

The lawsuit alleges that the facility, however, failed to honor their commitment as caregivers, which led to the spread of the virus to the elderly victims.

The Arbor Company claims to have observed all infection-control protocols to the letter. They also said that as soon as they suspected a case within the facility, they informed public health officials, as directed by the state. The company has since declined to comment on the suit.

The families filed the lawsuits in a Fulton County State Court despite an earlier executive order by the Georgian Governor that exempts health care providers, hospitals, and long term care facilities from legal liabilities relating to the coronavirus pandemic.
